This transition period of 2-months is required for modification and consecutive replacement of Cockpit Voice Recorders from P/N 980-6020-001 to P/N 980-6022- 001. If during this granted transition period Airest Inc. will not be able to modify all Cockpit Voice Recorders P/N 980-6020-001 to P/N 980-6022-001, Airest will replace Cockpit Voice Recorders with new ones. Plan for replacement of the Cockpit Voice Recorders on Airest SAAB fleet during the transition period is established by Airest CAMO and is attached to existing application. Confirm revision status through the EASA-Internet/Intranet. numpages3 An agency of the European Union  OTSUS Tallinn 10.01.2019 nr 1.1-11/19/4 Otsus erandi andmise kohta Võttes aluseks Euroopa Parlamendi ja nõukogu määruse (EL) 2018/1139 artikli 71 lõike 1 (alusmäärus), lennundusseaduse § 7 lõike 11 (viide vastavalt alusmääruse võrdlustabelile) ning lennuettevõtja AS Airest’i (registrikood 10101647, AOC EE-016) 19.12.2018 esitatud taotluse nr 1/267, mille kohaselt lennuettevõtjal ei õnnestunud tarneprobleemide tõttu täita Euroopa Komisjoni määruse (EL) nr 965/2012 nõude punkti CAT.IDE.A.185 (c) (2) nõuet, mis sätestab, et hiljemalt 1. jaanuariks 2019 peab kabiini helisalvestusseade (CVR) võimaldama säilitada andmeid, mis on salvestatud vähemalt eelneva kahe tunni jooksul, o t s u s t a n: 1. anda lennuettevõtjale AS Airest erand Euroopa Komisjoni määruse (EL) nr 965/2012 nõude punktist CAT.IDE.A.185 (c) (2). 2. See erand kehtib ainult SAAB 340A lennukitele ES-LSA/ES-LSB/ES-LSC/ES- LSE/ES-LSG/ES-LSF/ES-LSI, mida käitab AS Airest. 3. AS Airest peab tegema kõik vajalikud toimingud, et viia punktis 2 nimetatud õhusõidukid täielikku vastavusse nõuetega võimalikult väiksema aja jooksul, informeerides Lennuametit nõude tagamise protsessist ja andes Lennuametile eelnevalt teada igast võimalikust kõrvalekaldest kokkulepitud plaanist. 4. Erand on antud punktis 2 nimetatud õhusõidukitele, et tagada hädavajalik käitamine, kuni vastavad modifikatsioonid on tehtud. 5. Erand kehtib 10.01.2019 kuni 01.03.2019, kui ei ole tühistatud enne kehtivusaja lõppu. 6. Kõik punktis 2 nimetatud õhusõidukitega toimunud lennud loetakse erandi hulka tagasiulatuvalt. 7. Erandist teavitada Euroopa Komisjoni ja Euroopa Lennundusohutusametit ning teisi liikmesriike vastavalt ettenähtud vormile (lisa 1). Käesolevat otsust on võimalik vaidlustada 30 päeva jooksul alates teatavakstegemisest esitades kaebuse Tallinna Halduskohtusse halduskohtumenetluse seadustikus sätestatud korras või vaide Lennuametisse haldusmenetluse seaduses sätestatud korras.
