HANKE ESEME TEHNILINE KIRJELDUS 1. Üldised mõisted. 1.1. Hange korraldatakse eesmärgiga sõlmida hankeleping 900 sülearvuti kasutusrendiks 48 kuuks. 2. Hankelepingu eseme tehnilise kirjelduse lugemine. 2.1. Iga viidet, mille hankija teeb käesolevas dokumendis mõnele riigihangete seaduse paragrahvi 88 lõikes 2 nimetatud alusele, kui pakkumuse tehnilisele kirjeldusele vastavuse kriteeriumile, tuleb lugeda selliselt, et see on täiendatud märkega „või sellega samaväärne“. 2.2. Iga viidet, mille hankija teeb käesolevas dokumendis ostuallikale, protsessile, kaubamärgile, patendile, tüübile, päritolule või tootmisviisile, tuleb lugeda selliselt, et see on täiendatud märkega „või sellega samaväärne“. 3. Tehnilised tingimused 3.1. Tingimused sülearvuti ühilduvusele: Tingimuse kirjeldus Kõigi pakutud sülearvutite kõik draiverid peavad olema sertifitseeritud Microsoft WHQL (Windows Hardware Quality Labs) poolt. 3.2. Leping sõlmitakse riigihanke „Sülearvutite ja tahvelarvutite ostmine ja rentimine raamlepinguga“ (viitenumber 232482) tulemusel sõlmitud raamlepingu nr 2/135-21 alusel, lähtudes tellija pakkumuse esitamise ettepanekust ja täitja pakkumusest nr 454353 minikonkursil „900 sülearvuti rentimine“ viitenumber 269581 (lepingu osa viitenr 232482 013 005 001). 1.2. Lepingule kehtivad kõik raamlepingus ja nimetatu lisades toodud tingimused, kui lepingus ei ole sätestatud teisiti. 1.3 Täitja annab tellijale kasutusrendile 48 kuuks Lisas 1 kirjeldatud tooted. 2. Lepingu dokumendid 2.1. Lepingu lahutamatuteks osadeks on raamleping ja nimetatu lisad, üleandmise- ja vastuvõtmise aktid, pooltevahelised kirjalikud teated ning kõik lepingu muudatused ja muud lisad. 2.2. Lepingu lisadeks lepingu allkirjastamisel on: 2.2.1 Tellimus (tehniline kirjeldus) - Lisa 1 2.2.2. Pakkumus - Lisa 2 3. Lepingu hind ja tasumine 3.1. Lepingu hind on 804 510,00 eurot, millele lisandub käibemaks. 3.2. Tellija tasub toodete eest hankelepingu üldtingimustes sätestatud korras. 3.3. Maksetähtaeg: 30 päeva. 3.4. Kasutusrendimakseid hakatakse arvestama toodete vastuvõtmisest tellija poolt. 4. Lepingu täitmine 4.1. Toodete tarneaeg: esimesel võimalusel kuid mitte hiljem kui 6 nädala jooksul alates tellija poolt allkirjastatud lepingu kättesaamise päevale järgnevast tööpäevast. 4.2. Garantiiperioodi kestus: 48 kuud. 4.3. Tarneaadress: Lõõtsa 8a, Tallinn 5. Muud tingimused 5.1. Leping jõustub allkirjastamise hetkest ja kehtib kuni lepingujärgsete kohustuste täitmiseni. 5.2. Pooled tagavad ja avaldavad, et lepingu sõlmimisega ei ole nad rikkunud ühtegi enda suhetes kehtiva seaduse, põhikirja või muu normatiivakti sätet ega ühtki endale varem sõlmitud lepingute ja kokkulepetega võetud kohustust. 5.3. Pooled kinnitavad ja tõendavad, et: 5.3.1. neil on seaduses ettenähtud piisav õigus- ja teovõime lepingu sõlmimiseks ning lepingust tulenevate kohustuste täitmiseks ja õiguste realiseerimiseks; 5.3.2. nende poolt lepingule ja selle lisadele allakirjutanud isikutele on antud piisavad volitused selle lepingu sõlmimiseks kooskõlas õigusaktide ja muude normatiivaktidega.  5.4. Lepingu sõlmimisega kaotavad kehtivuse kõik pooltevahelised varasemad kokkulepped niivõrd, kuivõrd need on vastuolus lepinguga. 5.5. Lepingu allakirjutamisega tõendavad pooled, et on tutvunud ja on nõus lepingu ja selle lisadega ning oluliste osadega ning mõistavad täielikult enesele võetavate kohustuste sisu ning nende tagajärgi. 6.
