Annex 1 – Technical specifications Public procurement “ Extension of the licence of FHIR profiling tool and purchase of consultations ” Purpose of the public procurement The Health Information System is a national database managed and developed by the Health and Welfare Information Systems Centre (TEHIK), bringing together the health data transmitted by healthcare providers. Data exchange in the current Health Information System is document-based, implementing the HL7 CDA standard as the basis for data exchange. However, document-based data exchange no longer meets today's needs and does not support the implementation of the strategy for developing and implementing state-organised event services. Consequently, a decision has been taken to transfer to the HL7 FIR, a standard that is much more flexible and supports event-based data exchange. In connection with the updating the H ealth I nformation S ystem and related data exchange, the development of the first services based on the FHIR standard began in 2023, and the work will continue in 2024 with the development of additional new FHIR services. T he Data Management Division is responsible for aligning the data composition to the new standard. In order to carry out the activities of Data Management Analysts , the contracting authority needs the additional resources described in clause 2. The Data Management Division will use additional resources for profiling, development of implementation guides and publication. General requirements The object of the public procurement is the extension of the licences and product support for the products Forge and Simplifier included in the product family offered by Firely (hereinafter: Products ) and the purchase of HL7 FHIR consultation service (hereinafter: Service ). Warranties and product support will be provided in accordance with the manufacturer's terms and conditions. Requirements for profiling and profile publication software The Product shall cover the basic functionality of the processes related to profiling (profiling, linking to code lists, profile validation and publication). The duration of the right to use the Product shall be one calendar year. The Product shall be accompanied by instructions for use for new users. The Product shall allow for user rights and product support for up to ten (10) users. If the provider of the Product is notified of any errors in the use of the product, the provider shall respond and eliminate the error in accordance with the product support details given in the public price list ( https://simplifier.net/pricing#supportDetails ). The contracting entity wants to extend the licence of the software from March 1, 2024 . If the parties conclude the contract at a later date, the period shall be extended accordingly, given that the contractor must be prepared to deliver the product for use as soon as possible after the conclusion of the contract. Requirements for the consultation service The contracting authority defines the Service as the provision of consultations for the contracting entity in the validation of profiles, as well as the provision of experience-based knowledge of best practices in the implementation of HL7 FHIR in the following areas: Profiling and profile validation; Publication of profiles and implementation guides; Terminology; Analysis and, where appropriate, modification of existing work processes; Documentation. A consultant providing the Service must have experience in advising other organisations on the implementation of HL7 FHIR, profiling and the validation of profiles. The expected volume of consultations within this period is up to 25 hours, but this number is not binding on the orders. Consultations will be ordered as needed and the contracting authority will not be required to pay for a fixed number of working hours.

The Health and Welfare Information Systems Centre hereby invites you to submit a tender in the negotiated public procurement procedure without prior publication of a tender notice “ Extension of the licence of FHIR profiling tool and purchase of consultations ”. General requirements The content and specifications of the object of the procurement have been laid out in the invitation to tender and in the annex “Technical specifications” (Annex 1). By submitting a tender, the tenderer declares that it accepts all terms and conditions described in the procurement documents and undertakes to perform the work subject to the procurement under the conditions specified by the contracting authority. The submission of variants is not allowed; it has the intellectual property rights required for the performance of the public contract; the tender shall be valid for a minimum period of 90 calendar days from the time limit for the submission of tenders; it is not subject to the grounds for exclusion as set out in 95 § (1) of the Public Procurement Act. If the contracting authority learns of the existence of any grounds for exclusion of the tenderer, the contracting authority may exclude the tenderer from the public procurement and refuse to award a public contract to such tenderer. Where appropriate, the tenderer shall indicate the part of its tender which is a business secret. If the tenderer has not specified a business secret, the contracting authority shall assume that the tender does not contain any business secrets. The contracting authority shall open the tenders after the time limit set for the submission of tenders has expired. Requirements for the content of the tender, and verification of suitability A tender is declared admissible if it complies with all requirements set out in the tender documents. To verify suitability, the contracting authority may ask the tenderer for further clarifications about the tender, which the tenderer undertakes to respond to within 3 working days at the latest. The contracting authority may declare a tender suitable if it does not contain any substantive deviations from the requirements specified in the tender documents. The following shall submitted as part of the tender: Filled-in value form (Annex 2); The tenderer’s contractual terms and conditions, including standard terms and conditions, for the provision of the service; The consultant's CV showing his or her previous experience in advising organisations implementing the FHIR standard; Details of the contractual contact person and the signatory (may be included in the draft contract submitted). Assessment of tenders A tender is declared successful if it complies with all the requirements established and the proposed value is appropriate with regard to the budgetary resources of the contracting authority. Rejection of tenders and declaration of the procedure invalid The contracting authority rejects and will not assess the tender(s) that: do not meet one or several of the requirements given in the procurement documents or if it is not possible to unambiguously verify the suitability of the tender from the tender or the clarifications, or if the tenderer has submitted false information; has/have not been submitted within the time limit; if the contracting authority does not have the budgetary resources needed to finance the performance of the contract. If there is a justifiable need, the contracting authority may declare the procurement procedure invalid on its own initiative. Justifiable needs may include, in particular, the following: the need to substantially change the object of the contract; the requirements on which the procedure is based have significantly changed and, therefore, the award of the contract proves unnecessary or impossible; the inconsistencies found in the procedure cannot be eliminated and therefore, the procedure cannot be lawfully completed.
