TECHNICAL REGULATIONS
for the radio interface
on radio equipment operating in the transmission or
transmission/reception mode in bands assigned to the amateur service

1. Basic considerations
2014/53/EU Directive of the European Parliament and of the Council of 16 April 2014 on the
harmonization of the laws of the Member States relating to the making available on the
market of radio equipment and repealing 1999/5/EC Directive was transposed into national
law by Government Decision no. 740/2016 on the making available on the market of radio
equipment, with subsequent amendments and completions.
This technical regulation contains the requirements for the use exempted from licensing of
radio spectrum for radio-terminal equipment operating in transmission or
transmission/reception mode, exclusively under the control of a communications network,
in bands assigned to the amateur service, and considers, in, compliance with the provisions
of Article 3 (2) and Articles 6 to 8 of 2014/53/EU Directive.
This technical regulation does not exclude the obligation for radio equipment introduced or
made available on the Romanian market to comply with 2014/53/EU Directive.
This regulation has fulfilled the obligations arising from Directive (EU) 2015/1535 of the
European Parliament and of the Council of 9 September 2015 on the procedure for the
provision of information in the field of technical regulations and rules on information society
services (OJ L 241, 17.9.2015, pp. 1-15).
All Romanian technical regulations regarding radio interfaces notified according to Directive
(EU) 2015/1535 will be published and available on the website of the National Authority for
Administration and Regulation in Communications (ANCOM) at the following
address: http://www.ancom.ro/regulations-interfaces_2723.

The activity in the amateur service is allowed only to the persons who have an amateur
radio authorization and have their domicile or residence in Romania, fact proved by the
identity card or by a document attesting the stay or residence on the Romanian territory.
The amateur radio license confers the right to use the radio bands assigned to the amateur
service, under the conditions of the respective authorization class, assigning a call sign.
The foreign radio amateur who holds an equivalent CEPT, CEPT Novice or CEPT Entry-Class
authorization can operate an amateur radio station on the Romanian territory based on the
authorization issued in the country of origin.
The requirements for radio terminal equipment operating in transmission or
transmission/reception mode, exclusively under the control of a communications network,
in bands assigned to the amateur service according to Decision no. 245 of 2017 issued by
the President of ANCOM on the regulation of the amateur service.
For the purposes of this technical regulation, interference-free and protection-free means
that harmful interference to radiocommunication services is not permitted and that
protection against interference from radiocommunication services cannot be claimed.
The use of radio spectrum by such equipment is permitted without interference and without
radio protection (secondary status) and only if such equipment complies with the conditions
set out in the Annex below.

Tutvustus. Tehniline norm sisaldab nõudeid raadiospektri kasutamise erandi kohta raadiovõrgu lõppseadmete
puhul, mis töötavad edastus- või saate-/vastuvõturežiimis ainult sidevõrgu kontrolli all amatöörteenuse jaoks
eraldatud sagedusalades, ning eelkõige kaalutakse vastavust direktiivi 2014/53/EL artikli 3 lõike 2 ja artiklite 6–8
sätetele.
Käesoleva tehnilise normiga ei välistata Rumeenia turule lastud või seal kättesaadavaks tehtud raadioseadmete
kohustust järgida direktiivi 2014/53/EL.
Põhjendus. Amatöörteenuse osutamine on lubatud üksnes isikutele, kellel on amatöörraadio litsents ja kelle elu- või
viibimiskoht on Rumeenias, mida kinnitab isikutunnistus või dokument, mis tõendab nende viibimist või elamist
Rumeenia territooriumil.
Amatöörraadio litsents annab õiguse kasutada satelliitamatöörteenusele määratud raadioribasid vastava loaklassi
tingimuste alusel, määrates selleks kutsungi.
Välisriigi raadioamatöör, kellel on samaväärne CEPT, CEPT Novice või CEPT Entry-Class luba, võib päritoluriigis
väljastatud loa alusel käitada Rumeenia territooriumil amatöörraadiojaama.
Tuleb järgida nõudeid raadioseadmetele, mis töötavad ainult sidevõrgu kontrolli all olevates edastus- või saate-
/vastuvõturežiimis sagedusribades, mis on määratud amatöörteenusele vastavalt ANCOMi 2017. aasta otsusele nr
245 amatöörteenuste reguleerimise kohta.
Käesoleva tehnilise normi kohaldamisel tähendavad häirete puudumine ja kaitse puudumine seda, et
raadiosideteenuste kahjulikud häired ei ole lubatud ning et ei saa väita, et sellised seadmed on raadiosideteenustest
tulenevate häirete eest kaitstud.
