The USB Type C microphone consists of active electronic circuit is considered as electronic device under EMCD. You shall not use RED harmonised standards for this kind of product as it does not fit within the definition of radio equipment as provided in the Article 2(1) of the RED: „ ‘radio equipment’ means an electrical or electronic product, which intentionally emits and/or receives radio waves for the purpose of radio communication and/or radiodetermination, or an electrical or electronic product which must be completed with an accessory, such as antenna, so as to intentionally emit and/or receive radio waves for the purpose of radio communication and/or radiodetermination;“ I hope this explanation will help you. The product is a USB type C microphone which can only be used when connected to Smartphone. By using Android/iOS App, it can be recorded the sound through this microphone. Since this microphone can’t be used standalone, it may be classified as ancillary equipment for mobile phone as per ETSI EN 301489-52 under RED. However, I heard that some surveillance bodies consider this product is a non-RF product. Thus, RED may not be applicable 1 but EN 55032/55035 under EMC is suitable. May I have a clear decision whether this product is fall into RED or EMCD? Thank you very much. Best Regards, Should you have any question, please feel free to contact me.
