Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the
Council of 25 October 2012 on European standardisation, amending Council Directives
89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC,
98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European
Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No
1673/2006/EC of the European Parliament and of the Council,1 and in particular Article 10(1)
thereof,
Whereas:
(1) Directive 2014/53/EU of the European Parliament and of the Council2 establishes a
regulatory framework for the making available on the market and putting into service
in the Union of radio equipment. The essential requirements for such equipment are
laid down in Article 3(3) of that Directive.
(2) Pursuant to Article 3(3) of Directive 2015/53/EU, the Commission is to specify which
categories or classes of radio equipment are concerned by each of the essential
requirements set out in points (a) to (i) of the first subparagraph of Article 3(3) of that
Directive.
(3) Point (g) of Article 3(3) of Directive 2014/53/EU provides that the radio equipment is
to support certain features ensuring access to emergency services.

(4) In Delegated Regulation (EU) 2019/3203, the Commission has specified that the
essential requirements set out in Article 3(3)(g) of Directive 2014/53/EU are to apply
to hand-held mobile telephones with features similar to those of a computer in terms of
capability to treat and store data (‘smartphones’). It is also specified that compliance
with those requirements is to be ensured through technical solutions for the reception
and processing of Wi-Fi data, data from Global Navigation Satellite Systems
compatible and interoperable with at least the Galileo system referred to in Regulation
(EU) No 1285/2013 of the European Parliament and of the Council4, and for the
making available of that data for transmission in emergency communications.
Delegated Regulation (EU) 2019/320 is to apply from 17 March 2022.
(5) In accordance with Article 16 of Directive 2014/53/EU, radio equipment which is in
conformity with harmonised standards or parts thereof the references of which have
been published in the Official Journal of the European Union is to be presumed to be
in conformity with the essential requirements of that Directive covered by those
standards or parts thereof.
(6) Harmonised standards for radio equipment should help to provide access to emergency
services by ensuring that the equipment is designed in such a way that it supports the
features required for such access and thus contribute to the free movement of radio
equipment, in particular smartphones, in the Union. Given that such standards are
technology-neutral and performance-based, they also contribute to ensuring equal
conditions of competition among relevant economic operators manufacturing radio
equipment, in particular small and medium-sized enterprises.
(7) The satellite navigation system established under the Galileo programme on the basis
of Regulation (EU) No 1285/2013 is a global navigation satellite system ('GNSS')
developed by the Union and specifically designed for civilian purposes. It can be used
by a variety of public and private actors in Europe and worldwide. The Galileo system
can be used in combination with other GNSS.
(8) Action in support of the Space Strategy for Europe5 is one of the strategic priorities for
European standardisation in support of Union legislation and policies, as stated in
point 2.6 of the Annual Union Work Programme for European standardisation for
20196.
(9) The European Telecommunications Standards Institute (ETSI) has indicated that the
work covered by the standardisation request falls within its area of competence.

(10) It is therefore appropriate to request that ETSI draft new harmonised standards in
support of Article 3(3)(g) of Directive 2014/53/EU in conjunction with Article 1 of
Delegated Regulation (EU) 2019/320.
(11) The harmonised standards should include detailed technical specifications of the
requirements set out in Article 3(3)(g) of Directive 2014/53/EU in conjunction with
Article 1 of Delegated Regulation (EU) 2019/320, especially with respect to the design
and manufacture of smartphones. They should also indicate clearly the correlation
between the technical specifications and the requirements they aim to cover. They
should be based on risk assessment and risk reduction methodologies and reflect the
generally acknowledged state of the art.
(12) Information as to which requirements are covered by a harmonised standard is
necessary when assessing, in accordance with Article 10(5) of Regulation (EU)
1025/2012, the compliance of the documents drafted by ETSI. Such information is
also necessary before publication of the references of the harmonised standards in the
Official Journal of the European Union in accordance with Article 10(6) of Regulation
(EU) 1025/2012. In each harmonised standard, ETSI should therefore describe the
extent to which it aims to cover the requirement set out in Article 3(3)(g) of Directive
2014/53/EU in conjunction with Article 1 of Delegated Regulation (EU) 2019/320.
(13) The European Standardisation Organisations (ESOs) have agreed to follow the
Guidelines for the execution of standardisation requests7.
(14) In order to ensure transparency and facilitate the execution of the requested
standardisation activities, ETSI should prepare a work programme and submit it to the
Commission.
(15) In order to enable the Commission to better monitor the requested standardisation
work, ETSI should provide the Commission with access to an overall project plan
containing detailed information on the execution of the standardisation request and
with annual reports on the progress made in the execution of the request and the
implementation of the work programme.
(16) Experience shows that during execution of the standardisation request, it may be
necessary to adjust the scope of the request or the deadlines set therein. ETSI should
therefore promptly report to the Commission if it considers that more time is required
to draft the standards than initially foreseen or that it is appropriate to adapt the scope
of the request, in order to allow the Commission to take appropriate action.
(17) In accordance with Article 10(3) of Regulation (EU) No 1025/2012, each
standardisation request is subject to acceptance by the relevant ESO. It is therefore
necessary to provide for the rules on validity of this request if it is not accepted by
ETSI.
(18) In order to ensure legal certainty as to the validity of the request after its execution, it
is appropriate to provide for a date of expiry of this Decision.
(19) The ESOs, the European stakeholders' organisations receiving Union financing, the
Commission Expert Group on Radio Equipment and the Telecommunication
Conformity Assessment and Market Surveillance Committee established by Article 45
of Directive 2014/53/EU have been consulted.

(20) The measures provided for in this Decision are in accordance with the opinion of the
Committee established by Article 22 of Regulation (EU) No 1025/2012,
HAS ADOPTED THIS DECISION:
Article 1
Requested standardisation activities
1. The European Telecommunications Standards Institute (ETSI) is requested to draft
the harmonised standards listed in Annex I to this Decision in support of Article
3(3)(g) of Directive 2014/53/EU, in conjunction with Article 1 of Delegated
Regulation (EU) 2019/320, for hand-held mobile phones with features similar to
those of a computer in terms of capability to treat and store data (‘smartphones’) by
the deadlines set in that Annex.
2. The standards referred to in the first paragraph shall meet the requirements set out in
Annex II.
3. ETSI shall provide the Commission with the titles of the requested harmonised
standards in all the official languages of the Union.
Article 2
Work programme
1. ETSI shall prepare a work programme indicating all the standards listed in Annex I,
the responsible technical bodies and a timetable for the execution of the requested
standardisation activities in line with the deadlines set in that Annex.
2. ETSI shall submit the draft work programme to the Commission by … [insert date:
two months after the notification of this Decision by the Commission].
3. ETSI shall give the Commission access to an overall project plan containing detailed
information on the execution of the requested standardisation activities.
Article 3
Reporting
1. ETSI shall report annually to the Commission on the execution of the request
referred to in Article 1, indicating the progress made in implementation of the work
programme referred to in Article 2.
2. ETSI shall submit the first annual report to the Commission by … [insert date: six
months after the notification of this Decision by the Commission]. Subsequent
annual reports shall be submitted to the Commission by 31 December each year.
3. ETSI shall provide the Commission with the final report by 31 December 2021.
4. ETSI shall promptly report to the Commission any major concerns relating to the
scope of the request referred to in Article 1 and the deadlines set out in Annex I.

Article 4
Validity of the standardisation request
1. If ETSI does not accept the request referred to in Article 1 within a month of
receiving it, the request may not constitute a basis for the standardisation activities
referred to in that Article.
2. This Decision shall expire on 31 December 2021.

ANNEX II
Requirements for the harmonised standards referred to in Article 1(1)
Part A. General requirements
1. Legal requirements to be supported by the harmonised standards
1.1 The harmonised standards, when applied jointly, shall support the application of the
requirements relating to access to emergency services set out in Article 3(3)(g) of Directive
2014/53/EU in conjunction with Article 1 of Delegated Regulation (EU) 2019/320 (“the
requirements”). The requirements shall be taken into account from the beginning and
throughout the entire process of developing the harmonised standards.
1.2 The harmonised standards shall include the following elements:
(a) detailed technical specifications of the requirements with regard to the design and
manufacture of hand-held mobile telephones with features similar to those of a
computer in terms of capability to treat and store data (‘smartphones’) with the
purpose of allowing compliance with those requirements;
(b) test methods and conditions to verify compliance of smartphones with the
specifications referred to in point (a);
(c) any warning information that is to be provided, where such information is necessary
to ensure that the compliance of the smartphones with the requirements is not
compromised.
1.3 The structure of the harmonised standards shall be such that a clear distinction can be
made between those clauses and sub-clauses of the standards which are necessary to be
applied in order to benefit from the presumption of conformity and those which are not. In the
case where those clauses or sub-clauses, which are not necessary to be applied, are applied
they shall not compromise or endanger the conformity with any of the requirements.
1.4 The harmonised standards shall not support any other legal requirements than those set
out in Article 3(3)(g) of Directive 2014/53/EU in conjunction with Article 1 of Delegated
Regulation (EU) 2019/320.
1.5 The harmonised standards shall address the elements referred to in point 1.2 in relation
to the specifications, test methods and conditions and information and shall not address any
other elements, in particular requirements, procedures, responsibilities, or obligations for any
economic operator, including notified or other bodies or market surveillance authorities.
1. 6 The harmonised standards shall not:
(a) make, in their normative part, any references to any of the requirements or
procedures set out in Directive 2014/53/EU or Delegated Regulation (EU) 2019/320;
(b) reproduce, in their normative part, any of the requirements or procedures set out in
Directive 2014/53/EU or Delegated Regulation (EU) 2019/320;
(c) modify any definitions set out in Directive 2014/53/EU or Delegated Regulation
(EU) 2019/320;

(d) define any legally relevant terms not defined in Directive 2014/53/EU or Delegated
Regulation (EU) 2019/320;
(e) contradict any provisions of Directive 2014/53/EU or Delegated Regulation (EU)
2019/320;
(f) make conformity with the standards dependent on requirements of an administrative
or organisational nature.
2. Legal requirements covered by an individual harmonised standard
2.1 When one of the harmonised standards listed in Annex I does not cover all of the
requirements applicable to the products falling under its scope, that standard shall indicate
which of the requirements applicable to those products it does not cover.
2.2 Where one of the harmonised standards listed in Annex I contains technical
specifications which do not support the application of the requirements, such technical
specifications shall be clearly distinguished from the specifications supporting those
requirements.
3. Relations with existing standards and standardisation requests under Directive
2014/53/EU
By Implementing Decision C(2015) 53762, the Commission made a request to the European
Committee for Electrotechnical Standardisation (CENELEC) and ETSI for the drafting and
revision of harmonised standards for radio equipment in support of Directive 2014/53/EU.
Implementing Decision C(2015) 5376 does not include a request to draft or revise harmonised
standards in support of the application of the requirements set out in Article 3(3)(g) of
Directive 2014/53/EU in conjunction with Article 1 of Delegated Regulation (EU) 2019/320.
Therefore, the harmonised standards listed in Annex I are not covered by Implementing
Decision C(2015) 5376.

Part B. Specific requirements
1. Requirements for all harmonised standards listed in Annex I
1.1 The harmonised standards shall reflect the generally acknowledged state of art,
including any relevant techniques proposed in scientific and research literature which
represent the state of the art.
1.2 The harmonised standards shall contain verifiable, objective and reproducible methods
in a controlled environment to ensure comparable verification of the technical specifications
for all the tested smartphones.
2. Requirements for the specific standards listed in Annex I
2.1 Standard A: Harmonised standard on compatibility and interoperability with the
Galileo system shall describe solutions that ensure the following:
(a) usage of caller location solutions based on a global infrastructure composed of at
least one constellation of satellites and a network of ground stations, which provides
accurate timing and geolocation information;
(b) capability to receive and process signals from one or more GNSS, and at least from
Galileo;
(c) capability to get a first position fix from any of the processed GNSS signals selected
by the smartphone manufacturer, in maximum 60 seconds for signal levels down to
minus 130 dBm;
(d) capability to achieve a horizontal position error of maximum 5 metres in open sky
conditions and maximum 25 metres in urban canyon conditions with a confidence
level of 95 % (2σ coverage factor), where open sky conditions and urban canyon
conditions are as defined, respectively, in points 2.1.8 (Figure 1) and 2.2.4.2 (Figure
3) of Annex VI to Delegated Regulation (EU) 2017/793;
(e) usage of satellite navigation message authentication techniques to detect spoofing
attacks.
2.2 Standard B: Harmonised standard on the use of GNSS raw measurements shall
describe solutions that ensure the following:
(a) availability of the GNSS raw measurements made during the location sessions;
(b) a description of the methodology to make available a minimum set of GNSS raw
measurements containing at least satellite identifiers, satellite constellations, carrier-
to-noise-density ratio, doppler, UTC time and satellites used in the positioning fix.

2.3 Standard C: Harmonised standard on the processing and making available for
transmission of the data referred to in Article 1(2) of Delegated Regulation (EU) 2019/320
shall describe solutions that ensure the following:
(a) compatibility of the processing and transmission mechanisms of handset-derived
caller location with the national Public Safety Answering Point (PSAP) systems
deployed;
(b) transmission of data referred to in Article 1(2) of Delegated Regulation (EU)
2019/320 through emergency communication, as defined in Article 2(38) of
Directive (EU) 2018/1972 of the European Parliament and of the Council4, of all
available types.
2.4 Standard D: Harmonised standard on the use of a wireless local area network5 for
positioning shall describe solutions that ensure the following:
(a) capability to implement positioning based on the 802.11 family of standards and
existing 802.11 based infrastructure;
(b) capability to get a first position fix from signals from Wi-Fi Access Points in
maximum 20 seconds;
(c) capability to achieve a horizontal position error of maximum 30 metres in an indoor
scenario with a confidence level of 67 % (1σ coverage factor).

relatif à la normalisation européenne, modifiant les directives 89/686/CEE et 93/15/CEE du
Conseil ainsi que les directives 94/9/CE, 94/25/CE, 95/16/CE, 97/23/CE, 98/34/CE,
2004/22/CE, 2007/23/CE, 2009/23/CE et 2009/105/CE du Parlement européen et du Conseil
et abrogeant la décision 87/95/CEE du Conseil et la décision nº 1673/2006/CE du Parlement
européen et du Conseil1, et notamment son article 10, paragraphe 1,
considérant ce qui suit:
(1) La directive 2014/53/UE du Parlement européen et du Conseil2 établit un cadre
réglementaire pour la mise à disposition sur le marché et la mise en service dans
l’Union d’équipements radioélectriques. Les exigences essentielles applicables à ces
équipements sont énoncées à l’article 3, paragraphe 3, de ladite directive.
(2) En vertu de l’article 3, paragraphe 3, de la directive 2014/53/UE, la Commission
précise les catégories ou classes d’équipements radioélectriques concernées par
chacune des exigences essentielles énoncées à l’article 3, paragraphe 3, premier alinéa,
points a ) à i), de ladite directive.
(3) L’article 3, paragraphe 3, point g), de la directive 2014/53/UE dispose que les
équipements radioélectriques sont compatibles avec certaines caractéristiques
permettant d’accéder aux services d’urgence.

(4) Dans le règlement délégué (UE) 2019/3203, la Commission a précisé que les exigences
essentielles énoncées à l’article 3, paragraphe 3, point g), de la directive 2014/53/UE
s’appliquent aux téléphones portables possédant des caractéristiques semblables à
celles d’un ordinateur du point de vue de la capacité de traitement et de stockage des
données (ci-après les «téléphones intelligents»). Il est également précisé que la
conformité à ces exigences doit être garantie au moyen de solutions techniques
permettant la réception et le traitement de données Wi-Fi et de données provenant de
systèmes mondiaux de navigation par satellite compatibles et interopérables au moins
avec le système Galileo visé dans le règlement (UE) nº 1285/2013 du Parlement
européen et du Conseil4, ainsi que la mise à disposition de ces donnés en vue de leur
transmission lors de communications d’urgence. Le règlement (UE) 2019/320
s’applique à partir du 17 mars 2022.
(5) Conformément à l’article 16 de la directive 2014/53/UE, les équipements
radioélectriques conformes à des normes harmonisées ou à des parties de normes
harmonisées dont les références ont été publiées au Journal officiel de l’Union
européenne sont présumés conformes aux exigences essentielles de cette directive qui
sont couvertes par ces normes ou parties de normes.
(6) Les normes harmonisées applicables aux équipements radioélectriques devraient
contribuer à fournir un accès aux services d’urgence en garantissant que l’équipement
est conçu de telle manière qu’il est compatible avec les fonctions requises pour cet
accès et contribuer ainsi à la libre circulation des équipements radioélectriques, et
notamment des téléphones intelligents, dans l’Union. Étant donné que ces normes sont
fondées sur le principe de neutralité technologique et sur la performance, elles
favorisent aussi des conditions de concurrence égales entre les opérateurs
économiques concernés fabriquant des équipements radioélectriques, notamment les
petites et moyennes entreprises.
(7) Le système de navigation par satellite mis en place dans le cadre du programme
Galileo sur la base du règlement (UE) nº 1285/2013 est un système global de
navigation par satellite («GNSS») élaboré par l’Union et spécifiquement conçu à des
fins civiles. Il peut être utilisé par divers acteurs publics et privés en Europe et dans le

(8) L’action à l’appui de la stratégie spatiale pour l’Europe5 est l’une des priorités
stratégiques de la normalisation européenne soutenant la législation et les politiques de
l’Union, comme indiqué au point 2.6 du programme de travail annuel de l’Union en
matière de normalisation européenne pour 20196.

(9) L’Institut européen de normalisation des télécommunications (ETSI) a indiqué que les
travaux couverts par la demande de normalisation relèvent de son domaine de
compétence.
(10) Il convient, par conséquent, de demander que l’ETSI élabore de nouvelles normes
harmonisées à l’appui de l’article 3, paragraphe 3, point g), de la directive 2014/53/UE
en liaison avec l’article 1er du règlement délégué (UE) 2019/320.
(11) Il convient que les normes harmonisées contiennent des spécifications techniques
détaillées des exigences énoncées à l’article 3, paragraphe 3, point g), de la directive
2014/53/UE en liaison avec l’article 1er du règlement délégué (UE) 2019/320,
notamment en ce qui concerne la conception et la fabrication des téléphones
intelligents. Ces normes devraient également clairement indiquer la corrélation entre
les spécifications techniques et les exigences qu’elles visent à couvrir. Elles devraient
se fonder sur des méthodologies d’évaluation et de réduction des risques et refléter
l’état de l’art généralement admis.
(12) Il est nécessaire de disposer d’informations précisant quelles exigences sont couvertes
par une norme harmonisée pour pouvoir évaluer, dans le respect de l’article 10,
paragraphe 5, du règlement (UE) 1025/2012, la conformité des documents élaborés par
l’ETSI. En outre, ces informations doivent être disponibles avant la publication des
références des normes harmonisées au Journal officiel de l’Union européenne
conformément à l’article 10, paragraphe 6, du règlement (UE) 1025/2012. Dans
chaque norme harmonisée, il convient, par conséquent, que l’ETSI décrive dans quelle
mesure elle vise à couvrir l’exigence énoncée à l’article 3, paragraphe 3, point g), de la
directive 2014/53/UE en liaison avec l’article 1er du règlement délégué (UE) 2019/320.
(13) Les organisations européennes de normalisation (OEN) ont accepté d’appliquer les
lignes directrices relatives à l’exécution des demandes de normalisation7.
(14) Afin de garantir la transparence et de faciliter la réalisation des activités de
normalisation demandées, il convient que l’ETSI prépare un programme de travail et
le soumette à la Commission.
(15) Afin de permettre à la Commission de mieux suivre les travaux de normalisation
demandés, il convient que l’ETSI mette à sa disposition un plan d’ensemble du projet
comportant des informations détaillées sur l’exécution de la demande de
normalisation, ainsi que des rapports annuels sur les progrès accomplis dans
l’exécution de la demande et la mise en œuvre du programme de travail.
(16) L’expérience montre que, lors de l’exécution de la demande de normalisation, il peut
se révéler nécessaire d’adapter la portée de la demande ou les délais qui y sont fixés. Il
convient, par conséquent, que l’ETSI fasse rapidement savoir à la Commission s’il
estime que l’élaboration des normes nécessite plus de temps que prévu initialement ou
qu’il y a lieu d’adapter la portée de la demande afin de permettre à la Commission de
prendre les mesures qui s’imposent.
(17) Conformément à l’article 10, paragraphe 3, du règlement (UE) nº 1025/2012, chaque
demande de normalisation est soumise à l’acceptation de l’OEN concernée. Il est donc
nécessaire de prévoir les règles concernant la validité de la présente demande, dans
l’hypothèse où elle ne serait pas acceptée par l’ETSI.

(18) Afin de garantir la sécurité juridique quant à la validité de la demande après son
exécution, il convient de prévoir une date d’expiration de la présente décision.
(19) Les OEN, les parties prenantes européennes qui bénéficient d’un financement de
l’Union, le groupe d’experts de la Commission sur les équipements radioélectriques et
le comité pour l’évaluation de la conformité et la surveillance du marché des
télécommunications institué par l’article 45 de la directive 2014/53/UE ont été
consultés.
(20) Les mesures prévues par la présente décision sont conformes à l’avis du comité
institué par l’article 22 du règlement (UE) nº 1025/2012,
A ADOPTÉ LA PRÉSENTE DÉCISION:
Article premier
Activités de normalisation demandées
1. L’Institut européen de normalisation des télécommunications (ETSI) est invité à
élaborer les normes harmonisées énumérées dans l’annexe I de la présente décision à
l’appui de l’article 3, paragraphe 3, point g), de la directive 2014/53/UE, en liaison
avec l’article 1er du règlement délégué (UE) 2019/320, pour les téléphones portables
possédant des caractéristiques semblables à celles d’un ordinateur du point de vue de
la capacité de traitement et de stockage des données (ci-après les «téléphones
intelligents»), dans les délais fixés dans ladite annexe.
2. Les normes visées au paragraphe 1 satisfont aux exigences énoncées dans
l’annexe II.
3. L’ETSI transmet à la Commission les intitulés des normes harmonisées demandées
dans toutes les langues officielles de l’Union.
Article 2
Programme de travail
1. L’ETSI prépare un programme de travail indiquant toutes les normes énumérées dans
l’annexe I, les organismes techniques qui en sont responsables et un calendrier
d’exécution des activités de normalisation demandées conforme aux délais fixés dans
ladite annexe.
2. L’ETSI remet le projet de programme de travail à la Commission au plus tard le ...
[insérer la date: deux mois à compter de la notification de la présente décision par la
Commission].
3. L’ETSI met à la disposition de la Commission un plan d’ensemble du projet
comportant des informations détaillées sur l’exécution des activités de normalisation
demandées.

Article 3
Rapports
1. L’ETSI fait rapport une fois par an à la Commission sur l’exécution de la demande
visée à l’article 1er, en indiquant l’avancement dans l’exécution du programme de
travail visé à l’article 2.
2. L’ETSI remet le premier rapport annuel à la Commission au plus tard le [insérer la
date: six mois à compter de la notification de la présente décision par la
Commission]. Les rapports annuels suivants sont transmis à la Commission pour le
31 décembre de chaque année.
3. L’ETSI remet le rapport final à la Commission le 31 décembre 2021 au plus tard.
4. L’ETSI informe sans tarder la Commission de toute préoccupation majeure
concernant la portée de la demande visée à l’article 1er ou les délais fixés dans
l’annexe I.
Article 4
Validité de la demande de normalisation
1. Si la demande visée à l’article 1er n’est pas acceptée par l’ETSI dans un délai d’un
mois à compter de sa réception, celle-ci ne peut servir de fondement pour les
activités de normalisation visées audit article.
2. La présente décision expire le 31 décembre 2021.

Exigences applicables aux normes harmonisées visées à l’article 1er, paragraphe 1
Partie A. Exigences générales
1. Exigences légales à respecter par les normes harmonisées
1.1. Les normes harmonisées, lorsqu’elles sont appliquées conjointement, supportent
l’application des exigences relatives à l’accès aux services d’urgence énoncées à l’article 3,
paragraphe 3, point g), de la directive 2014/53/UE, en liaison avec l’article 1er du règlement
délégué (UE) 2019/320 (ci-après les «exigences»). Les exigences sont prises en compte
depuis le début et tout au long du processus d’élaboration des normes harmonisées.
1.2. Les normes harmonisées comprennent les éléments suivants:
a) les spécifications techniques détaillées des exigences relatives à la conception et à la
fabrication de téléphones portables possédant des caractéristiques semblables à celles
d’un ordinateur du point de vue de la capacité de traitement et de stockage des
données (ci-après les «téléphones intelligents») dans le but de permettre la
conformité à ces exigences;
b) les méthodes et conditions d’essai pour la vérification de la conformité des
téléphones intelligents aux spécifications visées au point a);
c) les éventuelles informations d’avertissement qui doivent être fournies, lorsque ces
informations sont nécessaires pour garantir que la conformité des téléphones
intelligents aux exigences n’est pas compromise.
1.3. La structure des normes harmonisées permet de distinguer clairement les clauses et
sous-clauses des normes qui doivent être nécessairement appliquées pour que l’on bénéficie
de la présomption de conformité et celles qui ne doivent pas l’être. Dans le cas où des clauses
ou sous-clauses qui ne doivent pas nécessairement être appliquées le sont, elles ne doivent pas
compromettre ou menacer la conformité à l’une quelconque des exigences.
1.4. Les normes harmonisées ne supportent pas d’autres exigences légales que celles
énoncées à l’article 3, paragraphe 3, point g), de la directive 2014/53/UE en liaison avec
l’article 1er du règlement délégué (UE) 2019/320.
1.5. Les normes harmonisées traitent des éléments visés au point 1.2 en rapport avec les
spécifications, les méthodes et conditions d’essai et les informations et ne traitent d’aucun
autre élément, notamment des exigences, procédures, responsabilités ou obligations imposées
à tout opérateur économique, y compris les organismes notifiés ou autres, ou aux autorités de
surveillance du marché.
1. 6 Les normes harmonisées ne doivent pas:
a) faire référence, dans leur partie normative, à l’une quelconque des exigences ou
procédures énoncées dans la directive 2014/53/UE ou le règlement délégué (UE)
2019/320;
b) reproduire, dans leur partie normative, l’une quelconque des exigences ou procédures
énoncées dans la directive 2014/53/UE ou le règlement délégué (UE) 2019/320;

c) modifier l’une quelconque des définitions figurant dans la directive 2014/53/UE ou
le règlement délégué 2019/320;
d) définir des termes légalement pertinents non définis dans la directive 2014/53/UE ou
le règlement délégué (UE) 2019/320;
e) contredire des dispositions de la directive 2014/53/UE ou du règlement délégué (UE)
2019/320;
f) rendre la conformité aux normes dépendante d’exigences de nature administrative ou
organisationnelle.
2. Exigences légales couvertes par une norme harmonisée individuelle
2.1. Lorsque l’une des normes harmonisées énumérées dans l’annexe I ne couvre pas
toutes les exigences applicables aux produits relevant de son champ d’application, cette
norme indique celles des exigences applicables à ces produits qu’elle ne couvre pas.
2.2. Lorsqu’une des normes harmonisées énumérées dans l’annexe I contient des
spécifications techniques qui ne supportent pas l’application des exigences, une différence
claire est établie entre lesdites spécifications techniques et celles qui supportent ces exigences.
3. Relations avec des normes et demandes de normalisation existantes au titre de la
directive 2014/53/UE
Par la décision d’exécution C(2015) 53762, la Commission a demandé au Comité européen de
normalisation électrotechnique (CENELEC ) et à l’ETSI d’élaborer et de réviser des normes
harmonisées relatives aux équipements radioélectriques à l’appui de la directive 2014/53/UE.
La décision d’exécution C(2015) 5376 n’inclut pas de demande d’élaboration ou de révision
de normes harmonisées supportant l’application des exigences énoncées à l’article 3,
paragraphe 3, point g), de la directive 2014/53/UE en liaison avec l’article 1er du règlement
délégué (UE) 2019/320. Par conséquent, les normes harmonisées énumérées dans l’annexe I
ne sont pas couvertes par la décision C(2015) 5376.

Partie B. Exigences particulières
1. Exigences concernant l’ensemble des normes harmonisées énumérées dans l’annexe I
1.1. Les normes harmonisées reflètent l’état de l'art généralement admis, y compris toutes
les techniques appropriées proposées dans la littérature scientifique qui représentent l’état de
l’art.
1.2. Les normes harmonisées contiennent des méthodes vérifiables, objectives et
reproductibles dans un environnement contrôlé pour garantir la vérification comparable des
spécifications techniques pour tous les téléphones intelligents soumis aux essais.
2. Exigences concernant les normes spécifiques énumérées dans l’annexe I
2.1. La norme A: norme harmonisée concernant la compatibilité et l’interopérabilité avec
le système Galileo décrit des solutions qui garantissent ce qui suit:
a) utilisation de solutions de localisation de l’appelant sur la base d’une infrastructure
mondiale composée d’au moins une constellation de satellites et d’un réseau de
stations terrestres, qui fournit des informations précises de datation et de
géolocalisation;
b) capacité de recevoir et de traiter des signaux provenant d’un ou plusieurs GNSS et au
moins de Galileo;
c) capacité d’obtenir un premier positionnement à partir de l’un quelconque des signaux
GNSS traités sélectionnés par le fabricant du téléphone intelligent en un temps
maximum de 60 secondes pour des niveaux de signal pouvant aller jusqu’à moins
130 dBm;
d) capacité d’atteindre une erreur de positionnement horizontal de maximum 5 mètres
dans des conditions de ciel dégagé et de maximum 25 mètres dans des conditions de
canyon urbain, avec un niveau de confiance de 95 % (facteur de couverture 2σ),
lorsque les conditions de ciel dégagé et les conditions de canyon urbain sont telles
que définies, respectivement, aux points 2.1.8 (figure 1) et 2.2.4.2 (figure 3) de
l’annexe VI du règlement délégué (UE) 2017/793;
e) utilisation de techniques d’authentification des messages de radionavigation par
satellite afin de détecter l’usurpation («spoofing»).
2.2 La norme B: norme harmonisée concernant l’utilisation des mesures GNSS brutes
décrit des solutions qui garantissent ce qui suit:
a) disponibilité des mesures GNSS brutes faites durant les sessions de localisation;
b) une description de la méthodologie permettant de proposer un ensemble minimal de
mesures GNSS brutes contenant au moins les identifiants des satellites, les

2.3. La norme C: norme harmonisée concernant le traitement et la mise à disposition pour
transmission des données visées à l’article 1er, paragraphe 2, du règlement délégué (UE)
2019/320 décrit des solutions qui garantissent ce qui suit:
a) compatibilité des mécanismes de traitement et de transmission de la localisation de
l’appelant via son téléphone portable avec les systèmes nationaux de centres de
réception des appels d’urgence (PSAP) déployés;
b) transmission des données visées à l’article 1er, paragraphe 2, du règlement délégué
(UE) 2019/320 via la communication d’urgence, telle que définie à l’article 2,
point 38), de la directive (UE) 2018/1972 du Parlement européen et du Conseil4, de
tous les types disponibles.
2.4. La norme D: norme harmonisée concernant l’utilisation d’un réseau local sans fil 5
pour le positionnement décrit des solutions qui garantissent ce qui suit:
a) capacité d’effectuer le positionnement sur la base de la famille de normes 802.11 et
de l’infrastructure existante s’appuyant sur celle-ci;
b) capacité d’obtenir un premier positionnement à partir des signaux de points d'accès
Wi-Fi en un temps maximum de 20 secondes;
c) capacité d’atteindre une erreur de positionnement horizontal d’un maximum de
30 mètres dans un scénario en intérieur, avec un niveau de confiance de 67 %
(facteur de couverture 1σ).

gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,
gestützt auf die Verordnung (EU) Nr. 1025/2012 des Europäischen Parlaments und des Rates
vom 25. Oktober 2012 zur europäischen Normung, zur Änderung der
Richtlinien 89/686/EWG und 93/15/EWG des Rates sowie der Richtlinien 94/9/EG,
94/25/EG, 95/16/EG, 97/23/EG, 98/34/EG, 2004/22/EG, 2007/23/EG, 2009/23/EG und
2009/105/EG des Europäischen Parlaments und des Rates und zur Aufhebung des
Beschlusses 87/95/EWG des Rates und des Beschlusses Nr. 1673/2006/EG des Europäischen
Parlaments und des Rates1, insbesondere auf Artikel 10 Absatz 1,
in Erwägung nachstehender Gründe:
(1) Die Richtlinie 2014/53/EU des Europäischen Parlaments und des Rates2 legt einen
Regelungsrahmen für die Bereitstellung auf dem Markt und die Inbetriebnahme von
Funkanlagen in der Union fest. Die grundlegenden Anforderungen für solche Anlagen
sind in Artikel 3 Absatz 3 der Richtlinie festgelegt.
(2) Gemäß Artikel 3 Absatz 3 der Richtlinie 2015/53/EU hat die Kommission festzulegen,
welche Kategorien oder Klassen von Funkanlagen von den einzelnen in Artikel 3
Absatz 3 Unterabsatz 1 Buchstaben a bis i der Richtlinie genannten Anforderungen
betroffen sind.

(3) Gemäß Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU müssen
Funkanlagen bestimmte Funktionen unterstützen, die den Zugang zu Rettungsdiensten
sicherstellen.
(4) In der Delegierten Verordnung (EU) 2019/3203 legt die Kommission fest, dass die in
Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU festgelegten grundlegenden
Anforderungen auf Handmobiltelefone mit Funktionen, die in Bezug auf die Fähigkeit
zur Datenverarbeitung und -speicherung denen eines Computers ähneln
(„Smartphones“), anzuwenden sind. Es wird außerdem festgelegt, dass die Einhaltung
dieser Anforderungen mithilfe technischer Lösungen für den Empfang und die
Verarbeitung von WLAN-Daten sowie von Daten aus globalen
Satellitennavigationssystemen, die zumindest mit dem in der Verordnung (EU)
Nr. 1285/2013 des Europäischen Parlaments und des Rates4 genannten Galileo-System
kompatibel und interoperabel sein müssen, und für die Bereitstellung dieser Daten für
die Übermittlung bei Notrufen gewährleistet werden muss. Die Delegierte Verordnung
(EU) 2019/320 gilt ab dem 17. März 2022.
(5) Nach Artikel 16 der Richtlinie 2014/53/EU wird bei Funkanlagen, die mit
harmonisierten Normen oder Teilen davon konform sind und deren Fundstellen im
Amtsblatt der Europäischen Union veröffentlicht worden sind, die Konformität mit
den grundlegenden Anforderungen der genannten Richtlinie, die von den betreffenden
Normen oder Teilen davon abgedeckt sind, vermutet.
(6) Harmonisierte Normen für Funkanlagen sollten dazu beitragen, den Zugang zu
Rettungsdiensten zu gewährleisten, indem Funkanlagen so konzipiert sind, dass sie die
für den Zugang zu den Diensten erforderlichen Funktionen unterstützen und dadurch
zum freien Verkehr von Funkanlagen, insbesondere Smartphones, in der Union
beitragen. Da es sich dabei um technologieneutrale und leistungsorientierte Normen
handelt, leisten sie auch einen Beitrag zur Wahrung gleicher Wettbewerbsbedingungen
für die betreffenden Wirtschaftsteilnehmer, die Funkanlagen herstellen, insbesondere
für kleine und mittlere Unternehmen.
(7) Das im Rahmen des Programms Galileo auf der Grundlage der Verordnung (EU)
Nr. 1285/2013 errichtete Satellitennavigationssystem ist ein globales
Satellitennavigationssystem („GNSS“), das von der Union entwickelt wurde und
speziell für zivile Zwecke konzipiert ist. Es kann von zahlreichen öffentlichen und
privaten Akteuren in Europa und weltweit genutzt werden. Das Galileo-System kann
in Kombination mit anderen GNSS genutzt werden.
(8) Die Maßnahmen zur Unterstützung der Weltraumstrategie für Europa5 sind Teil der
strategischen Prioritäten für die europäische Normung zur Unterstützung von

Rechtsvorschriften und politischen Maßnahmen der Union, wie unter Nummer 2.6 des
jährlichen Arbeitsprogramms 2019 der Union für europäische Normung6 angegeben.
(9) Das Europäische Institut für Telekommunikationsnormen (ETSI) hat angegeben, dass
die Arbeiten, die Gegenstand des Normungsauftrags sind, in ihren
Zuständigkeitsbereich fallen.
(10) Es ist daher angezeigt, das ETSI mit der Ausarbeitung neuer harmonisierter Normen
zur Unterstützung von Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in
Verbindung mit Artikel 1 der Delegierten Verordnung (EU) 2019/320 zu beauftragen.
(11) Die harmonisierten Normen sollten ausführliche technische Spezifikationen zu den
unter Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in Verbindung mit
Artikel 1 der Delegierten Verordnung (EU) 2019/320 aufgeführten Anforderungen
beinhalten, insbesondere betreffend den Entwurf und die Herstellung von
Smartphones. Darüber hinaus sollten sie eindeutig die Wechselbeziehungen zwischen
den technischen Spezifikationen und den Anforderungen angeben, die sie abdecken
sollen. Sie sollten auf der Grundlage der Methoden zur Risikobewertung und
Risikobegrenzung formuliert sein und den allgemein anerkannten Stand der Technik
widerspiegeln.
(12) Für die gemäß Artikel 10 Absatz 5 der Verordnung (EU) Nr. 1025/2012
durchzuführende Prüfung der Übereinstimmung der vom ETSI ausgearbeiteten
Dokumente sind Angaben darüber erforderlich, welche Anforderungen von einer
harmonisierten Norm abgedeckt werden. Diese Informationen werden auch benötigt,
bevor nach Artikel 10 Absatz 6 der Verordnung (EU) 1025/2012 die Fundstellen der
harmonisierten Normen im Amtsblatt der Europäischen Union veröffentlicht werden
können. Daher sollte das ETSI in jeder harmonisierten Norm beschreiben, in welchem
Umfang sie die in Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in
Verbindung mit Artikel 1 der Delegierten Verordnung (EU) 2019/320 festgelegte
Anforderung abdecken soll.
(13) Die europäischen Normungsorganisationen haben sich bereit erklärt, die Leitlinien für
die Ausführung von Normungsaufträgen7 zu befolgen.
(14) Zur Gewährleistung von Transparenz und zur Erleichterung der Durchführung der in
Auftrag gegebenen Normungstätigkeiten sollte das ETSI ein Arbeitsprogramm
ausarbeiten und der Kommission vorlegen.
(15) Im Hinblick auf eine bessere Überwachung der in Auftrag gegebenen
Normungsarbeiten durch die Kommission sollte das ETSI der Kommission einen
allgemeinen Projektplan vorlegen, in dem detaillierte Angaben zur Durchführung des
Normungsauftrags enthalten sind, sowie jährliche Berichte über die Fortschritte bei
der Auftragsausführung und die Umsetzung des Arbeitsprogramms.
(16) Wie die Erfahrung gezeigt hat, kann es im Zuge der Ausführung des
Normungsauftrags erforderlich werden, den Umfang des Auftrags oder die darin
festgelegten Fristen anzupassen. Das ETSI sollte die Kommission daher unverzüglich
unterrichten, wenn es der Ansicht ist, dass die Entwicklung der Normen länger als

vorgesehen dauert oder es sinnvoll wäre, den Umfang des Auftrags anzupassen, damit
die Kommission geeignete Maßnahmen ergreifen kann.
(17) Gemäß Artikel 10 Absatz 3 der Verordnung (EU) Nr. 1025/2012 steht jeder
Normungsauftrag unter dem Vorbehalt seiner Annahme durch die betreffende
europäische Normungsorganisation. Folglich ist es erforderlich, Regeln für die
Gültigkeit des vorliegenden Normungsauftrags für den Fall festzulegen, dass er vom
ETSI nicht angenommen wird.
(18) Im Interesse der Rechtssicherheit hinsichtlich der Gültigkeit des Auftrags nach seiner
Ausführung ist es angezeigt, ein Ablaufdatum für die Gültigkeit dieses Beschlusses
festzulegen.
(19) Die europäischen Normungsorganisationen, die europäischen Interessenverbände, die
Finanzhilfen der Union erhalten, die Sachverständigengruppe der Kommission für
Funkanlagen und der nach Artikel 45 der Richtlinie 2014/53/EU eingesetzte
Ausschuss für Konformitätsbewertung von Telekommunikationsgeräten und
Marktüberwachung wurden konsultiert.
(20) Die in diesem Beschluss vorgesehenen Maßnahmen entsprechen der Stellungnahme
des gemäß Artikel 22 der Verordnung (EU) Nr. 1025/2012 eingesetzten
Ausschusses —
HAT FOLGENDEN BESCHLUSS ERLASSEN:
Artikel 1
In Auftrag gegebene Normungstätigkeiten
1. Das Europäische Institut für Telekommunikationsnormen (ETSI) wird aufgefordert,
die harmonisierten Normen für Handmobiltelefone mit Funktionen, die in Bezug auf
die Fähigkeit zur Datenverarbeitung und -speicherung denen eines Computers
ähneln, („Smartphones“), die in Anhang I dieses Beschlusses zur Unterstützung des
Artikels 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in Verbindung mit
Artikel 1 der Delegierten Verordnung (EU) 2019/320 aufgeführt sind, innerhalb der
im genannten Anhang festgelegten Fristen auszuarbeiten.
2. Die in Absatz 1 genannten Normen müssen die in Anhang II festgelegten
Anforderungen erfüllen.
3. Das ETSI übermittelt der Kommission die Titel der in Auftrag gegebenen
harmonisierten Normen in allen Amtssprachen der Union.
Artikel 2
Arbeitsprogramm
1. Das ETSI bereitet ein Arbeitsprogramm vor, in dem alle in Anhang I genannten
Normen, die zuständigen technischen Gremien sowie ein Zeitplan für die
Durchführung der in Auftrag gegebenen Normungstätigkeiten gemäß den im
genannten Anhang festgelegten Fristen enthalten sind.
2. Das ETSI legt der Kommission den Entwurf des Arbeitsprogramms bis zum …
[Datum einfügen: zwei Monate nach der Übermittlung dieses Beschlusses durch die
Kommission] vor.

3. Das ETSI ermöglicht der Kommission den Zugang zu einem allgemeinen
Projektplan, der detaillierte Informationen zur Ausführung der in Auftrag gegebenen
Normungstätigkeiten enthält.
Artikel 3
Berichterstattung
1. Das ETSI erstattet der Kommission jährlich Bericht über die Ausführung des in
Artikel 1 genannten Auftrags, wobei die Fortschritte bei der Durchführung des in
Artikel 2 genannten Arbeitsprogramms dargelegt werden.
2. Das ETSI legt der Kommission den ersten Jahresbericht bis zum … [Datum
einfügen: sechs Monate nach der Übermittlung dieses Beschlusses durch die
Kommission] vor. Nachfolgende Jahresberichte werden der Kommission bis zum
31. Dezember des jeweiligen Jahres vorgelegt.
3. Das ETSI legt der Kommission den Abschlussbericht bis zum 31. Dezember 2021
vor.
4. Das ETSI unterrichtet die Kommission unverzüglich über alle wichtigen Bedenken
in Bezug auf den Umfang des in Artikel 1 genannten Auftrags und die in Anhang I
festgelegten Fristen.
Artikel 4
Gültigkeit des Normungsauftrags
1. Nimmt das ETSI den Auftrag nach Artikel 1 nicht innerhalb eines Monats nach
dessen Eingang an, so kann er nicht als Grundlage für die in diesem Artikel
genannten Normungstätigkeiten dienen.
2. Die Geltungsdauer dieses Beschlusses endet am 31. Dezember 2021.

Anforderungen an die harmonisierten Normen gemäß Artikel 1 Absatz 1
Teil A: Allgemeine Anforderungen
1. Rechtliche Anforderungen, die durch die harmonisierten Normen unterstützt werden
sollen
1.1. Die harmonisierten Normen sollen gemeinsam angewandt die Anwendung der in
Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in Verbindung mit Artikel 1 der
Delegierten Verordnung (EU) 2019/320 festgelegten Anforderungen bezüglich des Zugangs
zu Rettungsdiensten (im Folgenden „Anforderungen“) unterstützen. Die Anforderungen sind
von Anfang an und während des gesamten Prozesses der Entwicklung der harmonisierten
Normen zu berücksichtigen.
1.2. Die harmonisierten Normen haben Folgendes zu enthalten:
(a) detaillierte technische Spezifikationen zu den Anforderungen betreffend den Entwurf
und die Herstellung von Handmobiltelefonen mit Funktionen, die in Bezug auf die
Fähigkeit zur Datenverarbeitung und -speicherung denen eines Computers ähneln,
(„Smartphones“), um die Einhaltung der Anforderungen zu ermöglichen;
(b) Prüfmethoden und -bedingungen zur Überprüfung der Konformität der Smartphones
mit den unter Buchstabe a genannten Spezifikationen;
(c) jegliche Warnhinweise, die anzugeben sind, wenn derartige Informationen
erforderlich sind, um sicherzustellen, dass die Smartphones den Anforderungen
uneingeschränkt entsprechen.
1.3. Harmonisierte Normen sollen so gegliedert sein, dass eindeutig unterschieden werden
kann, welche Abschnitte und Unterabschnitte der Normen angewandt werden müssen, um
sich auf die Konformitätsvermutung berufen zu können, und welche nicht. Werden die
Abschnitte und Unterabschnitte, die nicht angewandt werden müssen, dennoch angewandt,
dürfen sie keine Beschränkung oder Gefährdung der Konformität mit anderen Anforderungen
darstellen.
1.4. Die harmonisierten Normen unterstützen keine anderen rechtlichen Anforderungen als
diejenigen nach Artikel 3 Absatz 3 Buchstabe g der Richtlinie 2014/53/EU in Verbindung mit
Artikel 1 der Delegierten Verordnung (EU) 2019/320.
1.5. Die harmonisierten Normen decken die unter Punkt 1.2. genannten Elemente zu den
Spezifikationen, Prüfmethoden und -bedingungen sowie Warnhinweisen ab, haben aber keine
anderen Elemente, insbesondere Anforderungen, Verfahren, Zuständigkeiten oder
Verpflichtungen für Wirtschaftsteilnehmer, einschließlich notifizierter oder anderer Stellen
oder Marktüberwachungsbehörden, zum Gegenstand.
1. 6. Die harmonisierten Normen
(a) enthalten im normativen Teil keinen Bezug auf die in der Richtlinie 2014/53/EU
oder der Delegierten Verordnung (EU) 2019/320 festgelegte Anforderungen und
Verfahren;

(b) geben in ihrem normativen Teil keine der in der Richtlinie 2014/53/EU oder der
Delegierten Verordnung (EU) 2019/320 festgelegten Anforderungen und Verfahren
wieder;
(c) ändern keine der in der Richtlinie 2014/53/EU oder der Delegierten Verordnung
(EU) 2019/320 festgelegten Begriffsbestimmungen;
(d) definieren keine rechtlich maßgeblichen Begriffe, die nicht in der
Richtlinie 2014/53/EU oder der Delegierten Verordnung (EU) 2019/320 definiert
worden sind;
(e) widersprechen keinen der in der Richtlinie 2014/53/EU oder der Delegierten
Verordnung (EU) 2019/320 festgelegten Vorschriften;
(f) machen die Konformität mit den Normen nicht von verwaltungstechnischen oder
organisatorischen Anforderungen abhängig.
2. Rechtliche Anforderungen, die von den einzelnen harmonisierten Normen abgedeckt
werden
2.1. Deckt eine der in Anhang I aufgeführten harmonisierten Normen nicht alle
Anforderungen ab, die auf die in ihren Geltungsbereich fallenden Produkte anwendbar sind,
so müssen in der Norm die von ihr nicht abgedeckten Anforderungen für diese Produkte
angegeben werden.
2.2. Enthält eine der in Anhang I aufgeführten harmonisierten Normen technische
Spezifikationen, die die Anwendung der Anforderungen nicht stützen, so sollen diese klar von
den Spezifikationen getrennt werden, die diese Anforderungen stützen.
3. Verbindung mit bestehenden Normen und Normungsaufträgen gemäß
Richtlinie 2014/53/EU
Mit dem Durchführungsbeschluss C(2015) 53762 stellte die Kommission bei dem
Europäischen Komitee für elektrotechnische Normung (CENELEC) und dem ETSI einen
Antrag auf Ausarbeitung und Überarbeitung der harmonisierten Normen für Funkanlagen zur
Unterstützung der Richtlinie 2014/53/EU. Der Durchführungsbeschluss C(2015) 5376 enthält
keinen Antrag auf Ausarbeitung oder Überarbeitung harmonisierter Normen zur
Unterstützung der Anwendung der in Artikel 3 Absatz 3 Buchstabe g der
Richtlinie 2014/53/EU in Verbindung mit Artikel 1 der Delegierten Verordnung (EU)
2019/320 festgelegten Anforderungen. Die in Anhang I aufgeführten harmonisierten Normen
fallen daher nicht unter den Durchführungsbeschluss C(2015) 5376.

Teil B: Spezifische Anforderungen
1. Anforderungen an alle in Anhang I aufgeführten harmonisierten Normen
1.1. Die harmonisierten Normen müssen den allgemein anerkannten Stand der Technik
widerspiegeln, einschließlich einschlägiger Techniken, die in der dem gegenwärtigen Stand
der Technik entsprechenden Wissenschafts- und Forschungsliteratur vorgeschlagen werden.
1.2. Die harmonisierten Normen müssen überprüfbare, objektive und reproduzierbare
Methoden in einer kontrollierten Umgebung enthalten, um sicherzustellen, dass die
technischen Spezifikationen aller getesteten Smartphones einer vergleichbaren Überprüfung
unterzogen werden können.
2. Anforderungen an die in Anhang I aufgeführten spezifischen harmonisierten Normen
2.1. Norm A: Die harmonisierte Norm für die Kompatibilität und Interoperabilität mit dem
Galileo-System beschreibt Lösungen, die das Folgende gewährleisten:
(a) Nutzung von Lösungen zur Anruferstandortbestimmung, die auf einer globalen
Infrastruktur von mindestens einer Satellitenkonstellation und einem Netz von
Bodenstationen basiert, die genaue zeitliche und Geolokalisierungsdaten liefert;
(b) Fähigkeit, Signale von einem oder mehreren GNSS und zumindest von Galileo zu
empfangen und zu verarbeiten;
(c) Fähigkeit, eine erste Positionsbestimmung anhand jeglicher verarbeiteter GNSS-
Signale, die vom Smartphone-Hersteller gewählt wurden, in höchstens 60 Sekunden
für Signalpegel bis zu minus 130 dBm vorzunehmen;
(d) Fähigkeit, eine Ungenauigkeit bei der horizontalen Positionsbestimmung von
höchstens 5 Metern bei wolkenlosen Witterungsverhältnissen und höchstens
25 Metern bei Straßenschlucht-Bedingungen bei einem Konfidenzniveau von 95 %
(2σ Erweiterungsfaktor) zu erreichen, wenn die wolkenlosen Witterungsverhältnisse
und Straßenschlucht-Bedingungen im Sinne der Punkte 2.1.8 (Abbildung 1) und
2.2.4.2 (Abbildung 3) des Anhangs VI der Delegierten Verordnung (EU) 2017/793
definiert sind;
(e) Nutzung von Authentifizierungstechniken bei der Nachrichtenübermittlung im
Rahmen der Satellitennavigation zur Ermittlung von Spoofing-Angriffen.
2.2. Norm B: Die harmonisierte Norm für die Nutzung von GNSS-Rohdaten beschreibt
Lösungen, die das Folgende gewährleisten:
(a) Verfügbarkeit der GNSS-Rohdaten, die während der Lokalisierung ermittelt wurden;

(b) Beschreibung der Methoden zur Bereitstellung eines Mindestsatzes an GNSS-
Rohdaten, in dem zumindest Satelliten-Identifikatoren, Satellitenkonstellationen,
Träger-Rauschdichte-Verhältnis, Doppler-Daten, Uhrzeit (UTC) und die Satelliten,
die bei der Positionsbestimmung verwendet wurden, enthalten sind.
2.3. Norm C: Die harmonisierte Norm für die Verarbeitung und Bereitstellung für die
Übermittlung der in Artikel 1 Absatz 2 der Delegierten Verordnung (EU) 2019/320 genannten
Daten beschreibt Lösungen, die das Folgende gewährleisten:
(a) Kompatibilität der Verarbeitungs- und Übermittlungsmechanismen von
Anruferstandortangaben von Endgeräten mit den eingesetzten Systemen nationaler
Notrufabfragestellen (PSAP);
(b) Übermittlung von Daten gemäß Artikel 1 Absatz 2 der Delegierten Verordnung (EU)
2019/320 über jegliche Art von Notruf im Sinne des Artikel 2 Absatz 38 der
Richtlinie (EU) 2018/1972 des Europäischen Parlaments und des Rates4.
2.4. Norm D: Die harmonisierte Norm für die Nutzung eines drahtlosen lokalen
Funknetzes (WLAN)5 für die Positionsbestimmung beschreibt Lösungen, die das Folgende
gewährleisten:
(a) Fähigkeit, die Positionsbestimmung mithilfe der 802.11-Standards und der
bestehenden auf 802.11 basierenden Infrastruktur umzusetzen;
(b) Fähigkeit, eine erste Positionsbestimmung innerhalb von höchstens 20 Sekunden
mithilfe von Signalen von WLAN-Zugangspunkten vorzunehmen;
(c) Fähigkeit, eine Ungenauigkeit bei der horizontalen Positionsbestimmung von
höchstens 30 Metern in Gebäuden bei einem Konfidenzniveau von 67 % (1σ
Erweiterungsfaktor) zu erreichen.

NOTE TO THE MEMBERS OF THE COMMITTEE ON STANDARDS
Subject: Launch of the written procedure on the Draft Commission Implementing
Decision on a standardisation request to the European
Telecommunications Standards Institute as regards hand-held mobile
phones in support of Directive 2014/53/EU of the European Parliament
and of the Council in conjunction with Commission Delegated Regulation
(EU) 2019/320
In the 19th meeting of the Committee of 24th June 2019, the draft standardisation request as
regards hand-held mobile phones in support of Directive 2014/53/EU in conjunction with
Commission Delegated Regulation (EU) 2019/320 was presented by the Commission and
discussed within the Committee.
In this meeting, it was also announced that the Commission intends to obtain the opinion of
the Committee on this draft standardisation request by written procedure. Hereby, the written
procedure is being initiated.
This is a formal step to endorse the draft standardisation request, and as such modifications
are not expected during this process.
The draft standardisation request takes account of the earlier consultations of the European
standardisation organisations and the European stakeholder organisations receiving Union
financing in accordance with the Regulation 1025/2012 on European standardisation, as well
as the consultations of sectoral experts from the Member States, in particular in the
Commission Expert Group on Radio Equipment and the Telecommunication Conformity
Assessment and Market Surveillance Committee established by Article 45 of Directive
2014/53/EU.
I attach the draft Commission Implementing Decision on the standardisation request in the
French, English and German language, in accordance with the agreed language regime of the
Committee for draft implementing acts.

In accordance with established rules, any Committee member who does not oppose the draft
implementing act or who does not explicitly abstain from voting thereon before the expiry of
that time limit shall be regarded as having tacitly agreed to the draft implementing act.
