HIGHLIGHTS OUTCOME OF THE MEETINGS OF THE CONFERENCES OF THE PARTIES TO THE BASEL, ROTTERDAM AND STOCKHOLM CONVENTIONS IN MAY 2023 The Rotterdam Convention COP-11 by decision RC-11/3 decided to amend Annex III to the Convention to list terbufos therein, making it subject to the Prior Informed Consent Procedure, and approved the related Decision Guidance Document: Chemical Relevant CAS Category Decision No. number(s) Terbufos 13071-79-9 Pesticide RC-11/3 The amendment to list terbufos in Annex III entered into force for all Parties on 22 October 2023. The Decision Guidance Document on terbufos was communicated to all Parties, along with a request to provide an import response within nine months of dispatch of this document (by 21 July 2024), in accordance with paragraph 2 of Article 10 of the Convention. At its eleventh meeting, the Conference of the Parties deferred to its twelfth meeting consideration of whether to include acetochlor, carbosulfan, chrysotile asbestos, fenthion (ultra-low volume (ULV) formulations at or above 640 g active ingredient/L), iprodione and liquid formulations (emulsifiable concentrate and soluble concentrate) containing paraquat dichloride at or above 276 g/L, corresponding to paraquat ion at or above 200 g/L. NINETEENTH MEETING OF THE CHEMICAL REVIEW COMMITTEE The nineteenth meeting of the Chemical Review Committee of the Rotterdam Convention was held from 3 to 6 October 2023 in Rome, Italy, back-to-back with the nineteenth meeting of the Persistent Organic Pollutants Review Committee of the Stockholm Convention. Having notifications for chlorpyrifos and mercury from at least two different PIC regions meeting the criteria, the Committee recommended the Conference of the Parties list these two chemicals in Annex III to the Convention. Draft decision guidance documents for these chemicals will be developed in the intersessional period and considered at the next CRC-20 meeting. In addition to the above-mentioned chemicals, the agenda of the CRC-19 meeting included the review of notifications of final regulatory actions for carbaryl, chlorfenvinphos, methidathion and thiodicarb submitted by Mozambique as decided by the CRC at its eighteenth meeting (CRC-18) to defer these notifications to the upcoming CRC-19 meeting. In light of the different views expressed by various CRC members on whether these notifications meet or not the Annex II (b) criteria, the Committee decided to continue the review of these notifications at its twentieth meeting. At its nineteenth meeting, the Committee adopted draft decision guidance documents for methyl bromide and paraquat and decided to forward them to the next twelfth meeting of the Conference of the Parties, together with a recommendation to list these chemicals in Annex III to the Convention. Secretariat of the Rotterdam Convention Page | 3 IMPORT RESPONSES FOR ALL ANNEX III CHEMICALS The Secretariat reminds all Parties of their obligation under Article 10 to submit import responses for all chemicals listed in Annex III. The form and instructions for the submission of import responses are available on the Convention website.1 Parties are invited to contact the Secretariat ( [email protected] or [email protected]) for any assistance in that regard. IMPORT RESPONSES FOR CHEMICALS RECOMMENDED FOR LISTING IN ANNEX III The Secretariat reminds all Parties of decisions RC-3/3, RC-4/4, RC-6/8, RC-8/6, RC-8/7 and RC-9/5 of the Conference of the Parties. These decisions encouraged Parties to make use of available information; to make informed decisions regarding the import and management; and to inform other Parties of those decisions using the information exchange provisions in Article 14. These decisions address the following chemicals: acetochlor; carbosulfan; chrysotile asbestos; fenthion (ultra-low volume (ULV) formulations at or above 640 g active ingredient/L); and liquid formulations (emulsifiable concentrate and soluble concentrate) containing paraquat dichloride at or above 276 g/L, corresponding to paraquat ion at or above 200 g/L. In line with these decisions and paragraph 1 of Article 14, Appendix VI of the PIC Circular contains information on chemicals recommended by the Chemical Review Committee for listing in Annex III but for which the Conference of the Parties has yet to take a final decision. Parties wishing to take advantage of this information exchange and to respond to the encouragement of the Conference of the Parties are invited to consult the information available on the Rotterdam Convention website and transmit any decisions regarding the import and management of these chemicals to the Secretariat. NOTIFICATIONS OF FINAL REGULATORY ACTIONS (FRAs) The Secretariat encourages Parties to review Appendix I, Part A of the PIC Circular (Summary of notifications of final regulatory action that have been verified to contain all the information required by Annex I to the Convention), which provides information on chemicals for which Parties have taken actions that do not require subsequent regulatory action and the purpose of which is to ban or severely restrict a chemical. These notifications were received from Parties between 1 May 2023 and 31 October 2023. More detailed information on the Final Regulatory Actions (FRAs) taken for these chemicals is available in the database on the Convention website. 2 The Secretariat also draws the attention of Parties to the list of chemicals in Appendix V, Part A, of the PIC Circular (Notifications of final regulatory action for chemicals not listed in Annex III and verified as containing all the information required by Annex I to the Convention). These notifications were received from Parties between September 1998 and 31 October 2023. The Secretariat encourages Parties, where appropriate, to give priority to these chemicals when considering final regulatory actions and in preparing notifications. If Parties require assistance in bridging information or in preparing notifications of final regulatory actions, they may contact the Secretariat at [email protected] or [email protected]. The Secretariat is inviting the Parties to make use of the Final Regulatory Action Evaluation Toolkit (FRAE Toolkit) aimed at assisting and enhancing the efforts by DNAs, especially those from developing country Parties and Parties that are countries with economies in transition, to take scientifically sound decisions and submit notifications of final regulatory actions (FRAs) under Article 5. Full and subsequently updated contact details as transmitted by Parties are available on the Convention website. 4 Parties are invited to review their contact details for accuracy and completeness and advise the Secretariat, in consultation with the Official Contact Points (OCPs) if necessary, of any updates, errors or omissions. UPDATE OF COUNTRY-SPECIFIC INFORMATION Country profile pages for each Party are available on the Convention website. 5 The country profiles provide information on DNAs and OCPs, import responses, notifications of final regulatory action, participation in meetings and technical assistance activities for each Party. Parties are invited to review the information provided on their country profile page and advise the Secretariat of any updates, errors or omissions. PARTIES TO THE CONVENTION As of 31 October 2023, there were 165 Parties to the Convention. Information on any new Parties for which the Convention enters into force after 31 October 2023 will be reported in the next PIC Circular.
