Subject: Meeting for discussion of Changes to MLC 2006 inspection requirements.
Dear Mr. Arikas
Although Lloyd’s Register has “Case by Case” authorisation to carry out MLC inspections on
board the ships flying Estonian Flag we applying to you in view of amendments of the
Regulations 2.5 and 4.2 which entered into force today (18 January 2017) and we kindly ask you
to advise Administration’s position for:
1. Standard A2.5.2 – Financial Security This standard requires a financial security system to be
provided to assist seafarers in the event of abandonment. The standard defines abandonment
as:
• when the shipowner fails to cover the cost of the seafarer’s repatriation; or
• when the shipowner has left the seafarer without the necessary maintenance and support;
• when the shipowner has otherwise unilaterally severed their ties with the seafarer, including
failure to pay contractual wages for a period of at least two months
2. Standard A4.2.1 – Shipowner’s Liability - This standard sets out the minimum requirements for
a system of financial security that assures compensation in the event of a contractual claim.
3. Documentary evidence of financial security on board
How it will apply to SRPS ? ( MLC2006 Regulation 1.4.5c(vi))
4. The SRPS must have in place an insurance cover or an equivalent appropriate measure, to
compensate seafarers for monetary loss that they may incur as a result of the failure from the
side of the SRPS and / or of the relevant shipowner to meet its obligations under the seafarers
employment agreement.
Mutual meeting for discussion of these amendments would be highly appreciated where we will be able
to discuss also other items related to Inspection of Crewing companies (SRPS) operating in Estonia such
as :
1. License or authorisation letter or similar document issued by the Administration.
2. List of the medical practitioner who issued the certificate and recognition by the Administration.
We are open to discuss other items for improvement of cooperation.
Please advise dates and time convenient for meeting enabling us to plan working schedule
Best regards,
Vladislavs Blums
