Dear Sir/Madam
In reference to the notice provided by the contracting authority on 20 December 2024, we are submitting the translation of the response to the claim by HSG Service and EMTech Solutions, UAB (hereinafter referred to as the Company) into Estonian. Additionally, we have included translations of the attachments to the response.
Please note that given the extremely short timeframe provided by the contracting authority (merely half a working day), the Company had no objective opportunity to obtain certified translations of the response and its attachments, especially considering their volume. Consequently, we are submitting translations performed by our internal resources.
We would like to emphasize that this procurement is international. The invitation to participate specified that proposals and accompanying documents could be submitted in either Estonian or English. Furthermore, the notification regarding the submission of the response did not indicate that the response and/or additional documents could not be submitted in one of the proposal submission languages - English. Therefore, the requirement for the Company, which is not established in Estonia, to submit a response in Estonian within such a short period is considered excessive and discriminatory towards foreign suppliers.
Nonetheless, we have dedicated all our resources to fulfill the additional requirements and are fully committed to cooperating and providing all necessary information and documents to resolve this matter efficiently.
In light of the above, we kindly request the contracting authority to accept the submitted document translations and to consider the Company's response to the claim along with the attachments when making a decision regarding the claim by OÜ Maksmi and LLC SPU TRANSAUTOMATIC. Should there be a need for officially certified translations, we kindly ask to be informed and granted an additional reasonable period to provide such documents.
Also, in regards to the request submitted in the response by the Contracting Authority on 20 December 2024, the Company gives consent for the conclusion of the procurement contract.

Viidates hankija poolt 20. detsembril 2024 esitatud teatele, esitame HSG Service ja EMTech Solutions, UAB (edaspidi nimetatud kui Ettevõte) vastuse eestikeelse tõlke. Lisaks oleme lisanud vastuse lisade tõlked.
Selgitame, et arvestades hankija poolt antud äärmiselt lühikest ajakava (vaid pool tööpäeva), ei olnud Ettevõttel objektiivset võimalust saada vastuse ja selle lisade sertifitseeritud tõlkeid, eriti arvestades nende mahtu. Seetõttu esitame tõlked, mis on tehtud meie sisemiste ressursside poolt.
Soovime rõhutada, et see hange on rahvusvaheline. Osalemiskutses oli märgitud, et ettepanekud ja kaasnevad dokumendid võivad olla esitatud kas eesti või inglise keeles. Lisaks ei olnud teates vastuse esitamise kohta märgitud, et vastus ja/või lisadokumendid ei võiks olla esitatud ühes pakkumise esitamise keeltest - inglise keeles. Seetõttu peetakse nõuet, et Ettevõte, mis ei ole asutatud Eestis, esitaks vastuse eesti keeles nii lühikese aja jooksul, ülemääraseks ja diskrimineerivaks välismaiste pakkujate suhtes.
Sellegipoolest oleme pühendanud kõik oma ressursid täiendavate nõuete täitmiseks ja oleme täielikult pühendunud koostööle ning kogu vajaliku teabe ja dokumentide esitamisele, et see küsimus tõhusalt lahendada.
Eeltoodut arvestades palume aktsepteerida esitatud dokumentide tõlked ja Ettevõtte vastust vaidele koos lisadega, kui tehakse otsus OÜ Maksmi ja LLC SPU TRANSAUTOMATIC vaide kohta. Kui on vaja ametlikult sertifitseeritud tõlkeid, palume meid sellest teavitada ja anda täiendav mõistlik ajavahemik selliste dokumentide esitamiseks.
Lisaks vastuseks Hankija 20.12.2024 taotlusele, annab Ettevõte nõusoleku hankelepingu sõlmimiseks.
