-864235 -144145 0 0 ASUTUSESISESEKS KASUTAMISEKS Märge tehtud: 06.09.2017 Kehtib kuni: 04.08.2022 Alus: AvTS § 35 lg 1 p 2 Teabevaldaja: Tehnilise Järelevalve Amet Silmani Elekter AS [email protected] Meie 06.09.17 nr 17-1/17-0408-013 Teade ohtlikust elektriseadmest Tehnilise Järelevalve Amet (edaspidi ka TJA) on Majandus- ja Kommunikatsiooniministeeriumi valitsemisalas tegutsev valitsusasutus, kes seadme ohutuse seaduses (edaspidi SeOS) sätestatud pädevuse piires teostab riikliku järelevalvet seadmete ja nendega seotud protsesside üle. Toote nõuetele vastavuse seaduse (edaspidi ka TNVS) § 50 lg 1 ja lg 5 punkti 2 kohaselt teeb TJA järelevalvet elektriseadmetele kehtestatud nõuete täitmise üle. Meile saabunud informatsiooni kohaselt, tegeleb Silman i Elekter AS (reg nr 10006280 ) India päritolu valgusti Sylvania Syl Batten LED 5,5/8 NW (foto lisatud) maaletoomise ja turustamisega. Tuginedes Euroopa turujärelevalveasutuste teavitussüstee mi Rapex teatele nr A12/1071/17 (lisatud), e i vasta nimetatud valgusti elektriohutusnõuetele. Kõnealune seade on teate kohaselt Suurbritannias vabatahtlikult turult kõrvaldatud. Tulenevalt e eltoodust, palume Silmani Elekter AS-l vabatahtlikult kõnealune seade müügilt kõrvaldada ning informeerida sellest ka edasimüüjaid /tarbijaid . Palume kirjalikult TJA-d teavitada rakendatud meetmetest ning teada anda, mida kavatsetakse teha kokku kogutud seadmetega ning kui suur on puudustega seadmete hulk. Seadme vabatahtlikult müügilt kõrvaldamisest keeldumise korral, oleme sunnitud TNVS § 56 lg 2 punkt 5 ja lg 4 alusel Teile tegema ettekirjutuse antud toodete turustamise peatamiseks, millele või b eelneda kõnealuse valgusti täiendavate elektriohutusalaste katsetuste läbiviimine. Puuduste ilmnemisel, tuleb Teil seadme katsetuste maksumus hüvitada. Toote nõuetele vastavuse seaduse § 58 lg 5 kohaselt võib ettekirjutuse täitmata jätmise korral riiklikku järelevalvet teostav ametiisik rakendada sunnivahendit asendustäitmise ja sunniraha seaduses sätestatud korras. Ettekirjutuse täitmata jätmise korral on TJA-l õigus rakendada sunniraha asendustäitmise ja sunniraha seaduses sätestatud korras kuni 10 000 eurot. Tulenevalt korrakaitseseaduse (edaspidi KorS) § 30 lõigetest 1 ja 3 on TJA-l ohu ennetamiseks, välja selgitamiseks või tõrjumiseks või korrarikkumise kõrvaldamiseks õigus saada vajaminevat informatsiooni ja tutvuda dokumentidega. Vastavalt haldusmenetluse seaduse (edaspidi HMS) § 38 lõikele 3 on menetlusosaline kohustatud haldusorganile esitama ja teatavaks tegema talle teadaolevad menetluses tähtsust omavad asjaolud ja tõendid. Menetlusosalisel on vastavalt HMS § 40 lõikele 1 õigus esitada asja kohta oma arvamus ja vastuväited. Ootame Teie vastust hiljemalt 28.09.2017 . Käesoleva haldusmenetluse toiminguga mittenõustumisel on isikul õigus 30 päeva jooksul dokumendi saamise päevast arvates esitada vaie TJA peadirektorile haldusmenetluse seaduses sätestatud korras või kaebus Tallinna Halduskohtule halduskohtumenetluse seadustikus sätestatud korras. It has been discovered that the minimum cross- sectional area of this wiring does not meet the safety standards applicable to this product. Where Luminaires are connected in a string, the current, under rare fault conditions will be low, because of the resistance of the wiring. The circuit protection may not operate before serious overheating and damage to the conductor and insulation occur within the Luminaire or the supply cable. In a worse-case scenario, this could result in exposed conductors and melting or ignition of insulation materials, triggering a risk of fire or electric shock. The above is due to errors by Havells in the specification of the cross-sectional area of the through wiring cable within the luminaire. Dimension of through wire is too small and sub-standard. As a result, the product does not comply with the EN 60598-1:2008 safety standard for Luminaires Legal provisions and standards Low Voltage Directive 2006/95/EC.
