Saatja: Arthur Le Gall <[email protected]> Saaja: Erika Adams, Tais Vakrõõm, Teodora Pletosu, Olha Hruba Teema: FW: Implementation of AVMS Directive - reporting Dear Erika Adams, I am contacting you from KEA European Affairs, a Brussels-based consultancy specialised in culture and creative industries. I’m getting in touch with you as I received an out-of-office reply from Tais Vakrõõm I sent earlier today. We are carrying out a study for DG CONNECT on the implementation of the AVMS Directive, which aims at providing the Commission with the tools and information required for the monitoring and evaluation of the impact of the measures, taken at Union and national levels, for the promotion of European works and independent production in broadcasting and on-demand services (as mentioned in the attached letter). As part of this study, we are carrying out several tasks for which your contribution is instrumental: * A legal analysis of implementing measures of AVMSD at national levels. We do this through an online survey available here: http://www.surveygizmo.com/s3/3413598/Survey-to-national-audiovisual-reg ulators-on-the-implementation-of-articles-13-16-17-of-the-AVMS-Directive <http://www.surveygizmo.com/s3/3413598/Survey-to-national-audiovisual-re gulators-on-the-implementation-of-articles-13-16-17-of-the-AVMS-Directiv e> This survey also aims at sourcing recommendations on how better monitor the implementation of AVMSD in the future, and more generally on improving its * Statistical reporting for the application of articles 16 and 17 as regards the measures to promote the production and distribution of European works in broadcasting services, including works made by independent producers. For this compulsory reporting, the Commission used to circulate templates that Member States filled with the necessary information. We have adapted these templates for each Member State (see attached Excel file). Please fill in those templates and send them back to us via email. Please note that reporting for the application of article 13 is embedded in the above-mentioned online survey. The reporting period is respectively 2013-2014 for linear services (Art. 16 & 17) and 2011-2014 for non-linear services (art.13) Please complete the survey and fill in the reporting table by Wednesday 5 April. We have tried to facilitate the process already by 1) re-using existing literature and especially the previous study on this topic (which can be accessed at http://ec.europa.eu/digital-agenda/en/avmsd-reports-european-works <http://ec.europa.eu/digital-agenda/en/avmsd-reports-european-works> ), in order to avoid requesting information you already provided; and 2) pre-filling the statistical reporting with a list of TV channels sourced from the MAVISE database of the European Audiovisual Observatory. We are available to provide support or further guidance and help you in completing those tasks, so please do not hesitate to get in touch with us. With best regards, <http://www.keanet.eu/> <https://www.facebook.com/groups/118858538127329/> <https://www.linkedin.com/groups/3019282> KEA CREATIVE EUROPE Arthur Le Gall t. +32 2 289 26 07 m. +32 486 67 94 02 a. 51 rue du Trône, 1050 Brussels, Belgium w. www.keanet.eu <http://www.keanet.eu> <https://www.facebook.com/KEAEuropeanAffairs/> <https://twitter.com/KEAtweets/> <https://www.linkedin.com/company/kea-european-affairs> EUROPEAN COMMISSION Directorate-General for Communications Networks, Content and Technology Media Policy Audiovisual and Media Policy Services Brussels, 25/01/2017 To whom it may concern, I hereby confirm that the European Commission awarded a contract to VVA Consulting and KEA European Affairs for a study on the promotion of European works in audiovisual media services (contract SMART 2016/0061). The study work started on 11 January 2017 for a period of maximum nine months. It aims at providing the Commission with the tools and information required for the monitoring and evaluation of the impact of the measures, taken at Union and national levels, for the promotion of European works and independent production in broadcasting and on-demand services. Under Articles 13(3) and 16(3) of the AVMSD, the Commission has to report to the European Parliament and to the Council: - every 4 years on the application of Articles 13 as regards the promotion of and access to European works in on-demand services; - and every two years on the application of Articles 16 and 17 as regards the measures to promote the production and distribution of European works in broadcasting services, including works made by independent producers. In preparation for this reporting, the Commission used to circulate templates that Member States filled with the necessary information. In order to avoid any possible overlaps between this exercise and the ongoing study, we decided to ask VVA Consulting and KEA European Affairs to collect the necessary information for drafting the reports on Article 13 (for the period 2011-2014), 16 and 17 (for the period 2013-2014). The Commission will then draft the report on the basis of the data collected. The contractors will contact you in this view as soon as possible. May I urge you to consider a timely reply to their request as a fulfilment of the obligation lay down under Article 13(2) and 16(3) of the AVMSD according to which Member States shall provide the Commission with this data. The scope of the study being broader, the contractor may also ask for additional information - e.g. best practices for monitoring and evaluation, efficient criteria to ensure the prominence and findability of EU works, etc. All information you will provide to Commission europėenne/Europese Commissie, 1049 Bruxelles/Brussel, BELGIQUE/BELGIË - Tel. +32 22991111 Office: BU25 5/181 - Tel. direct line +32 229- 90009 them in this respect will be of great value to the Commission, and so we thank you in advance for your cooperation and contribution. Please note that the contractor is contractually bound to treat with confidentiality any information and documents identified as such, disclosed in writing or orally in relation to the performance of the contract for this study. Yours faithfully, 2
